Danaos Shipping is committed to establish and consolidate a framework for a safe work environment that is free from all forms of violence, harassment and bullying.
The Company, demonstrating zero tolerance for incidents of violence and harassment in the workplace, adopts this Policy, in compliance with the prevailing Laws and Regulations. The respective text of the Law applies alongside with this Policy.
All employees have the right to a work environment free of violence and harassment, to be treated with respect and dignity, and to report any such incident of prohibited workplace behavior.
The purpose of this Policy is:
- to ensure that all employees are protected against violence and harassment at the workplace, including gender-based and sexual harassment, adverse discrimination and intimidation
- to declare zero tolerance against any such incident and to prevent and eliminate any potential conduct that affects a person’s employment or performance, directly or indirectly or creates an intimidating, hostile or offensive working environment
- to take all appropriate and necessary measures with the aim to ensure a supportive climate that discourages violence and harassment, and encourages reporting of such behaviour by all employees
- to define the relevant prohibited behaviour and actions
- to assess the risks and provide the respective framework and measures to be followed when someone is considered being harmed, bullied or harassed
The Company is also committed to the protection of employment and the support of working victims of domestic violence, where possible, by any appropriate means or reasonable accommodation. Any employee who has suffered domestic violence is encouraged to report such fact following the below mentioned procedure.
Definitions:
Violence and Harassment means the forms of behavior, actions, practices or threats thereof, which are intended, lead or may lead to physical, psychological, sexual or financial harm, whether manifested individually or repeatedly.
Bullying at work is an ongoing and deliberate misuse of power through offensive, intimidating, malicious or insulting behavior, intended to undermine, humiliate, denigrate, or injure the recipient.
Bullying does not include legitimate and constructive criticism of employees performance or behaviour, an occasionally raised voice, or an argument.
Harassment is defined as any form of unwanted physical, verbal or non-verbal conduct which has the purpose or effect of violating a person’s dignity and creating an intimidating, hostile, degrading, humiliating or offensive working environment for the person. It may be related to age, race, disability, religion, nationality, ethnic or national origin or any personal characteristic of the individual and may be persistent or an isolated incident.
Gender based Harassment is an unwelcome conduct linked to a person’s gender which is degrading, abusive, intimidating, or hostile. Such conduct may include sexual harassment as well as forms of behavior linked to a person’s sexual orientation, expression, identity or gender characteristics and can be a single act, incident, or statement, as well as a pattern or series of acts, incidents, or statements.
Violence & Harassment include but are not limited to the following behaviors:
- threatened or actual physical violence.
- derogatory comments, nicknames, slurs, jokes, pranks, stereotypes, or insults.
- creating, sharing or displaying derogatory or inappropriate written materials, images, electronic messages, videos, or music.
- comments or behavior intended to threaten or intimidate
- other nonverbal behavior, including intimidation, stalking, or inappropriate staring, that threatens or reasonably could be perceived to threaten another.
- shouting or swearing, insulting someone’ appearance, spreading malicious rumours.
- persistent criticism, overbearing supervision, setting up individuals up to fail by imposing impossible deadlines, blocking opportunities for holiday, promotion or training, undermining staff, social exclusion, isolation or victimization.
- threats related to the position and working conditions.
- acts of retaliation.
- sexual comments, innuendos, jokes, gestures as well as immoral or offensive comments about gender or sexual orientation or indistinct questions about personal or sexual life.
- sexually suggestive or derogatory remarks, leering at a person’s body, unwanted touches, whistles, caresses, kisses, compromising invitations, demands for sexual favours, sexually suggestive or degrading objects, pictures, written materials, emails, text messages or faxes in the workplace.
